Pitstop Hero Terms of Service

1.Acceptance of Terms

By creating an account or using Pitstop Hero, you agree to be bound by these Terms of Service, our Privacy Policy, our Child Safety Standards, and any community guidelines referenced herein.

Pitstop Hero is operated by Spota Labs, Inc. ("SpotaLabs", "we", "us"). Pitstop Hero is community-powered roadside help: drivers request help with non-emergency car trouble and get matched with verified enthusiasts nearby ("Heroes"), who can accept requests and earn Car Karma and bounties.

2.User Eligibility

  • Must be at least 18 years old (or older where local law requires)
  • Must be able to form a legally binding contract
  • Pitstop Hero may suspend access if age, identity, or account behavior violates our policies

3.Use of the Platform

You may use Pitstop Hero to:

  • Request help with non-emergency car trouble
  • Get matched with verified Heroes nearby and track them live
  • Thank Heroes with Car Karma or a bounty
  • Help other drivers as a verified Hero

You may not use the platform to:

  • Harass, stalk, or track others without consent
  • Post hate speech, explicit content, or violent material
  • Impersonate other users or misrepresent who you are
  • Engage in unauthorized promotions or scams
  • Reverse engineer or exploit the app technically
  • Make false or prank requests

4.Account Security

  • You're responsible for keeping your credentials confidential
  • You must notify us immediately at support@spotalabs.app of unauthorized activity
  • We reserve the right to suspend or delete accounts due to policy violations

5.User-Generated Content (UGC)

  • You retain ownership of any photos, videos, recordings, documents, or other content you upload
  • By uploading content, you grant SpotaLabs a non-exclusive, royalty-free, worldwide license to host, store, display, and share it as needed to operate and improve Pitstop Hero. We'll only feature your content in our marketing with your permission
  • You may not upload content you don't have the rights to (e.g. stolen photos, other people's documents)

6.Roadside Help & Heroes

Pitstop Hero is not an emergency service. If you or anyone else is in danger, injured, or blocking traffic, call your local emergency number first.

Heroes Are Community Members:

  • Heroes are community members, not employees, agents or contractors of SpotaLabs, and we don't direct how they help.
  • Verification and background checks have limits and don't guarantee anyone's conduct or skill.
  • We can't guarantee that a Hero will be available. You can decline help or cancel a request at any time.

Car Karma & Bounties:

  • Car Karma is a virtual reward with no cash value. It can't be bought, sold or exchanged for money.
  • Bounties are payments you choose to offer. When and how they're charged is shown in the app before you confirm.
  • Heroes are responsible for any taxes on bounties they earn.

Hero Rules:

  • Only accept requests you can handle safely, with the right skills and equipment.
  • Don't do work that legally requires a license or certification you don't have.
  • Don't ask for payment outside the app.
  • Stop and leave if a situation becomes unsafe, and report it.

Roadside Safety:

  • Get yourself and your vehicle somewhere safe before requesting help, and use your hazard lights.
  • Stay out of live traffic and follow local laws.

7.Misuse Policy

Prohibited Activities:

  • Using anyone's location or contact details for anything other than the active request.
  • Asking for or taking payment outside the app.
  • Creating fake accounts or impersonating others.
  • Using bots, scrapers, or unauthorized third-party apps.

Prohibited Content:

  • Content that promotes illegal activities or dangerous driving.
  • Harassment, bullying, or discriminatory content.
  • Copyrighted material without proper authorization.
  • Personal information of others without consent.
  • Any content that sexualizes or endangers minors, which we report to the authorities (see our Child Safety Standards).

8.Subscription & Billing

  • Pitstop Hero is free to download. Pitstop Hero Turbo and the SpotaLabs Ecosystem plan are optional subscriptions, billed monthly or yearly.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Subscriptions are purchased and billed through the Apple App Store or Google Play. You can manage or cancel them in your store account settings. Deleting the app or your account doesn't cancel a subscription.
  • Bounties are paid by card through our payment processor (e.g. Stripe), not the App Store or Google Play.
  • No refunds are issued for unused subscription time unless required by law. Refunds for App Store and Google Play purchases are handled by Apple and Google under their policies.

9.Location Usage

  • Your precise location is used when you request help, to find nearby Heroes and guide your Hero to you
  • Your location is only shared with the Hero who accepts your request, for as long as the request is active
  • If you're a Hero and allow it, your location is used in the background while you're marked as available and during an active job
  • We never track you in the background without explicit permission

10.Data Collection

We collect data to provide and improve our services. For detailed information about what we collect and how we use it, please review our Privacy Policy.

11.Vehicle Information

Vehicles in Requests:

  • Describe your vehicle and the problem accurately, so Heroes know what they're getting into.
  • Only request help for vehicles you own or are responsible for.

12.Community Guidelines

Respectful Behavior:

  • Treat all community members with respect and courtesy.
  • Be honest in everything you post and every deal you make.
  • Report inappropriate behavior or content to help maintain community standards.

13.Intellectual Property

Pitstop Hero and its original content, features, and functionality are owned by Spota Labs, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

14.Limitation of Liability

Pitstop Hero is provided "as is". To the fullest extent permitted by law, SpotaLabs is not liable for any indirect or consequential damages arising from the use of our services or from dealings with other users, including but not limited to personal injury, property damage, or data loss. Users are responsible for their own safety and compliance with local laws. Nothing in these terms limits any liability that can't be limited by law.

15.Termination

You can stop using Pitstop Hero and delete your account at any time. We may suspend or terminate your account at any time for violations of these terms, or for any activity deemed harmful to the community or platform.

16.Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of updated terms.
