Shifta1.Acceptance of Terms
By creating an account or using Shifta, you agree to be bound by these Terms of Service, our Privacy Policy, our Child Safety Standards, and any community guidelines referenced herein.
Shifta is operated by Spota Labs, Inc. ("SpotaLabs", "we", "us"). Shifta helps car enthusiasts swap cars: you list your car and what you'd swap it for, get matched with people who want your car and have one you want, compare estimated values, and arrange a swap.
2.User Eligibility
- Must be at least 18 years old (or older where local law requires)
- Must be able to form a legally binding contract
- Shifta may suspend access if age, identity, or account behavior violates our policies
3.Use of the Platform
You may use Shifta to:
- List your car and what you'd swap it for
- Get matched with owners who want your car and have one you want
- Compare estimated values and review vehicle details and history
- Message your matches and arrange a swap
You may not use the platform to:
- Harass, stalk, or track others without consent
- Post hate speech, explicit content, or violent material
- Impersonate other users or misrepresent who you are
- Engage in unauthorized promotions or scams
- Reverse engineer or exploit the app technically
- List vehicles you don't own or aren't authorized to trade
4.Account Security
- You're responsible for keeping your credentials confidential
- You must notify us immediately at support@spotalabs.app of unauthorized activity
- We reserve the right to suspend or delete accounts due to policy violations
5.User-Generated Content (UGC)
- You retain ownership of any photos, videos, recordings, documents, or other content you upload
- By uploading content, you grant SpotaLabs a non-exclusive, royalty-free, worldwide license to host, store, display, and share it as needed to operate and improve Shifta. We'll only feature your content in our marketing with your permission
- You may not upload content you don't have the rights to (e.g. stolen photos, other people's documents)
6.Swaps & Meetups
Swaps Are Between Owners:
- SpotaLabs isn't a party to any swap, sale or agreement between users. We aren't a dealer or broker, we don't inspect vehicles, and we don't hold money, keys or titles.
- You and the other owner are responsible for agreeing the terms, settling any value difference, transferring title and registration, taxes, insurance, and following local laws.
Values, History & Verification:
- Values are estimates, not appraisals or offers.
- History information comes from third-party sources and may be incomplete or wrong.
- Verification confirms specific information at a point in time. It doesn't guarantee a person, a vehicle or its condition.
- Get an independent pre-purchase inspection and check the title, VIN and documents in person before you swap.
Meetup Rules:
- Keep conversations in the app, meet in a public place during the day, and bring someone with you.
- Don't hand over keys, title or money until both sides are ready.
- Never send deposits, gift cards or payments to someone you haven't met.
7.Misuse Policy
Prohibited Activities:
- Listing stolen vehicles, or vehicles you can't legally trade (e.g. financed cars without your lender's consent).
- Misrepresenting a car's condition, mileage, title or history.
- Posting as a private owner while trading as a business.
- Creating fake accounts or impersonating others.
- Using bots, scrapers, or unauthorized third-party apps.
Prohibited Content:
- Content that promotes illegal activities or dangerous driving.
- Harassment, bullying, or discriminatory content.
- Copyrighted material without proper authorization.
- Personal information of others without consent.
- Any content that sexualizes or endangers minors, which we report to the authorities (see our Child Safety Standards).
8.Subscription & Billing
- Shifta is free to download. Shifta Turbo and the SpotaLabs Ecosystem plan are optional subscriptions, billed monthly or yearly.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Subscriptions are purchased and billed through the Apple App Store or Google Play. You can manage or cancel them in your store account settings. Deleting the app or your account doesn't cancel a subscription.
- No refunds are issued for unused subscription time unless required by law. Refunds for App Store and Google Play purchases are handled by Apple and Google under their policies.
9.Location Usage
- Location is used to find matches near you and show distances
- Other users only see your general area (city or region), never your exact location
- Shifta does not track your location in the background
10.Data Collection
We collect data to provide and improve our services. For detailed information about what we collect and how we use it, please review our Privacy Policy.
11.Listings & Vehicle Information
Vehicle Listings:
- You may only list vehicles you own or are authorized to trade.
- Describe your car honestly, including known defects, accident history, title brands (such as salvage or rebuilt) and any loans or liens.
- Use your own, current photos and keep your listing up to date.
12.Community Guidelines
Respectful Behavior:
- Treat all community members with respect and courtesy.
- Be honest in everything you post and every deal you make.
- Report inappropriate behavior or content to help maintain community standards.
13.Intellectual Property
Shifta and its original content, features, and functionality are owned by Spota Labs, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
14.Limitation of Liability
Shifta is provided "as is". To the fullest extent permitted by law, SpotaLabs is not liable for any indirect or consequential damages arising from the use of our services or from dealings with other users, including but not limited to personal injury, property damage, or data loss. Users are responsible for their own safety and compliance with local laws. Nothing in these terms limits any liability that can't be limited by law.
15.Termination
You can stop using Shifta and delete your account at any time. We may suspend or terminate your account at any time for violations of these terms, or for any activity deemed harmful to the community or platform.
16.Changes to Terms
We reserve the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of updated terms.

18.Effective Date
These Terms of Service are effective as of September 30, 2026, and apply to all users of Shifta.
